La presente informativa viene resa ai sensi e per gli effetti dell’art. 13 del Regolamento Ue n. 2016/679 del 27 aprile 2016 (di seguito anche “GDPR”) relativo alla protezione delle persone fisiche con riguardo al trattamento dei dati personali. Nello specifico, BHB World Srl, quale Titolare del Trattamento, desidera informare che, in attuazione degli obblighi derivanti dal GDPR, è tenuta a fornire alcune informazioni riguardanti le modalità e le finalità del trattamento dei dati personali, dei quali la stessa potrà entrare in possesso a seguito della consultazione e dell’utilizzo del sito web da parte dell’utente.

- Tutti i contenuti inseriti volontariamente dall’utente saranno visibili dal Titolare del trattamento e dai suoi incaricati.

I dati personali dell’Interessato, raccolti e registrati per accedere ai servizi di e-commerce e news letter, saranno trattati in forma strettamente riservata dal Titolare e dai soggetti dallo stesso incaricati, e potranno essere utilizzati ai soli fini sopra indicati e per fini statistici in forma aggregata o comunque in modo tale da renderli anonimi.

  1. b) Dati di navigazione: i sistemi informatici e le procedure software preposte al funzionamento del servizio e-commerce acquisiscono, nel corso del loro normale esercizio, alcuni dati personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet.

In questa categoria di dati rientrano gli indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che si connettono al sito, gli indirizzi in notazione URI (Uniform Resource Identifier) delle risorse richieste, l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore, ecc.) ed altri parametri relativi al sistema operativo e all'ambiente informatico dell'utente.

Questi dati vengono utilizzati al solo fine di ricavare informazioni statistiche anonime sull’uso del sito e per controllarne il corretto funzionamento. I dati potrebbero essere utilizzati per l’accertamento di responsabilità in caso di ipotetici reati informatici ai danni del servizio e-commerce e del Titolare solo su richiesta degli organi di vigilanza preposti.

 

2.2 FINALITÀ DEL TRATTAMENTO. 

2.2 a) I dati personali saranno trattati per la corretta esecuzione della piattaforma e-commerce e delle operazioni richieste dagli interessati. I dati personali raccolti sono trattati al fine di consentire l’utilizzo del servizio di acquisto on line. Tali dati potranno altresì essere trattati per l’adempimento di tutti gli obblighi imposti dalla legge (quali, a titolo esemplificativo e non esaustivo: finalità fiscali, finalità antiriciclaggio L. 231/07 e s.m.i.).  

2.2 b) I dati personale e segnatamente indirizzo e-mail e numero di recapito mobile saranno trattati solo previo Suo specifico e distinto consenso (artt. 23 e 130 Codice Privacy e art. 7 GDPR), per le seguenti Finalità di Marketing:

  • inviarLe newsletter, comunicazioni commerciali e/o materiale pubblicitario su prodotti o servizi offerti dal Titolare e rilevazione del grado di soddisfazione sulla qualità dei servizi;
  • inviarLe sms marketing contenenti comunicazioni commerciali e offerte su prodotti o servizi offerti dal Titolare;
  • identificazione, anche mediante elaborazioni elettroniche di comportamenti ed abitudini di consumo in modo da migliorare i servizi ed i prodotti offerti, soddisfare esigenze specifiche e indirizzare le proposte commerciali di interesse.

Si precisa che i dati personali trattati per la finalità di marketing diretto sono: nome, cognome, e-mail, numero di telefono. Nel caso in cui l’interessato abbia espresso il proprio consenso al momento di iscrizione alla newsletter, o all’sms marketing, oppure lo esprima successivamente e fino alla revoca dello stesso, i dati personali potranno essere trattati dal Titolare anche per finalità di marketing diretto, ovvero per l’invio di e-mail a carattere informativo, pubblicitario e/o promozionale, l’invio di sms anch’essi a carattere informativo, pubblicitario e/o promozionale e, più in generale, per l’invio di comunicazioni commerciali. Tale trattamento verrà effettuato tramite modalità automatizzate di contatto, e segnatamente attraverso posta elettronica e sms (ove sia stato prestato il consenso).

2.3 Resta ferma la possibilità per il Titolare di trattare i dati predetti in forma anonima e aggregata, nel rispetto delle misure prescritte dal Regolamento UE e dalle Linee guida del Garante privacy ed in virtù dello specifico esonero dal consenso previsto dalla medesima Autorità, per analisi ed elaborazioni elettroniche (ad esempio, la classificazione dell’intera classe di utenti in categorie omogenee per livelli di servizi, consumi, spesa, ecc.) dirette a monitorare periodicamente lo sviluppo e l’andamento economico delle attività di BHB World Srl. ai fini del miglioramento dei servizi e dell’ottimizzazione del servizio di e-commerce.

2.4 I dati acquisiti per effettuare il pagamento mediante PayPal verranno trattati da PayPal (Europe) s.à.r.l. et Cie, S.C.A., 22-24-Boulevard Royal l 2449, Lussemburgo. Le ricordiamo, infatti, che BHB World Srl non tratta i Suoi dati necessari per effettuare il pagamento ma riceve esclusivamente la comunicazione dell’avvenuto pagamento da parte del Titolare PayPal.2.5 Per quanto concerne la disabilitazione dei cookies, Si rimanda alla privacy e cookies del sito

3.1 La base giuridica per il trattamento dei dati personali sopra indicati è:

- quanto al punto 2.1 lettera a), Tipi di dati trattati, la necessità di eseguire i servizi richiesti dall’Utente che effettua un acquisto mediante il servizio di e-commerce, ed il rispetto degli obblighi di legge relativi alla fatturazione;

- quanto al punto 2.1 lettera b), Tipi di dati trattati, la necessità di consentire la navigazione nel sito; 

- quanto al punto 2.2 lettera a), Finalità del trattamento, il rispetto degli obblighi di legge e la necessità di eseguire i servizi previsti da parte del Titolare del trattamento. Pertanto, il conferimento dei dati è obbligatorio e l’eventuale mancato conferimento potrebbe comportare la mancata esecuzione o la sospensione, finanche l'interruzione, della prestazione di servizi offerti;

5.1 I dati necessari per la fornitura del servizio verranno conservati dal Titolare per il tempo necessario per fornire i servizi erogati ovvero fino all’esaurimento del servizio medesimo da parte del Titolare. Il Titolare potrà inoltre conservare le informazioni personali dell’utente anche dopo l’erogazione del servizio previsti se questa conservazione è ragionevolmente necessaria per ottemperare ad obblighi legali e fiscali, soddisfare i requisiti regolamentari, risolvere dispute tra utenti, prevenire frodi e abusi o applicare la presente informativa sulla privacy. 8.2 A riguardo si informa che il termine per la risposta all'interessato è, per tutti i diritti di un mese dal ricevimento della richiesta, estendibili fino a tre mesi in casi di particolare complessità.

9.1 L’interessato ha diritto di proporre reclamo all’Autorità Garante del Trattamento dei dati.

9.2 Il reclamo è lo strumento che consente all'interessato di rivolgersi al Garante per lamentare una violazione della disciplina in materia di protezione dei dati personali ai sensi dell’art. 77 del GDPR e di richiedere una verifica all’Autorità.

9.3 Il reclamo può essere proposto dall’Interessato all’Autorità di Controllo del luogo dove risiede, oppure nel luogo in cui lavora o in quello nel quale la presunta violazione si è verificata.

9.4 L’Interessato ha diritto altresì di proporre un ricorso giurisdizionale innanzi al Tribunale ordinario qualora ritenga che i diritti di cui gode siano stati violati a seguito di un trattamento.

  1. COMPLAINT TO THE GUARANTEE AUTHORITY

9.1 The interested party has the right to lodge a complaint with the Data Processing Authority.

9.2 The complaint is the tool that allows the interested party to contact the Guarantor to complain about a violation of the regulations on the protection of personal data pursuant to art. 77 of the GDPR and to request a verification from the Authority.

9.3 The complaint can be lodged by the interested party with the Supervisory Authority of the place where he resides, or in the place where he works or in the place where the alleged violation has occurred.

9.4 The interested party also has the right to bring a judicial appeal before the ordinary Court if he believes that the rights he enjoys have been violated following a treatment.
